SB 399 Prohibits Employers from Retaliating Against Employees Who Refuse Political or Religious Communications
In recent years, businesses have increasingly become platforms for political/social messaging, which may alienate employees who do not share the same views. California’s SB 399, The Worker Freedom from Employer Intimidation Act, is a new law designed to protect employees from attending employee-mandated meetings to discuss political and religious matters, including the decision to join or support a labor union. Signed into law by California Gov. Gavin Newsom, effective January 1, 2025, SB 399 makes it illegal for employers to retaliate against workers who refuse to attend meetings, where the employer expresses opinions on religious or political matters. SB 399 strengthens the foundation of employment law in California by ensuring that personal beliefs are protected from unwarranted influence in the workplace.
SB 399 highlights the importance of balancing employer interests with the protection of individual rights in the workplace.
